Welcome to Kaleidoscope Pets (“KPETS”), owned and operated by Amanda Brown (also known as Kandria). By accessing or using the website (https://kaleidoscopepets.com), participating in our Discord server, or creating an account, you agree to the following Terms of Service and Privacy practices. If you do not agree, do not use the site.

1. Age Requirements & COPPA Compliance

KPETS is a 13+ website and community. Users under the age of 13 are not permitted to register or use the site in compliance with the Children's Online Privacy Protection Act (COPPA).

If it is discovered that a user is under 13, their account will be suspended or deleted as required by law.

2. User Accounts

You must provide accurate information during registration.
You are responsible for keeping your password secure.
Account sharing, buying, selling, or trading is prohibited.
Staff may suspend or terminate accounts that violate these Terms.
Users banned from Discord may also be banned from the website and vice versa.

3. Virtual Pets, Items, Currency, and Ownership

All virtual pets, items, artwork, and assets on KPETS remain the exclusive property of Kaleidoscope Pets. Users receive a limited, revocable license to use these virtual assets within the site only.

Virtual items have no real-world monetary value.
KPETS may modify, remove, revoke, or redistribute virtual items at any time.
Virtual pets and items may be confiscated in cases of rule violations, fraud, or chargebacks.

User-Uploaded Artwork & MYOs

By uploading any artwork (including MYOs), the user grants KPETS a perpetual, worldwide, royalty-free license to store, display, modify, and use the artwork for site functionality.

Users retain copyright only to the character concept or idea they created, but not to the KPETS pet art files or rendered assets themselves. KPETS retains full rights to remove, alter, or delete uploaded pet images at any time.

4. Cross-Site Trading

KPETS allows cross-site trading but does so at the user’s own risk. While KPETS will work with cooperating websites to resolve trade issues, we cannot guarantee their cooperation.

5. Acceptable Use Policy

You agree not to engage in any of the following:

Harassment, discrimination, hate speech, or targeted attacks.
Sharing inappropriate, explicit, or adult content (KPETS is PG-13).
Spamming, advertising, or self-promotion without staff approval.
Using bots, automation, exploits, bugs, or scripts to gain advantage.
Uploading copyrighted content you do not own the rights to.
Attempting to hack, cheat, manipulate trades, or bypass security.
“Mini-modding” — only staff may enforce rules.
Any action that disrupts the community, Discord server, or website.

Violations may result in warnings, suspensions, or permanent bans.

6. Payment, Refunds, and Chargebacks

KPETS may offer digital goods for USD via PayPal. All sales are final unless required by law. KPETS does not offer voluntary refunds.

Chargebacks are treated as equivalent to refunds; accounts involved in chargebacks are subject to immediate suspension until all funds are recovered.

7. Moderation & Enforcement

Staff may, at their discretion:

Suspend, ban, or restrict accounts.
Reverse trades or transfers involving scamming or fraud.
Confiscate pets or items obtained improperly.
Remove or edit content posted by users.
Log IP addresses and data necessary for security.
Take action on Discord or the website interchangeably.

KPETS will intervene in disputes, bullying, harassment, or unsafe behavior.

8. Site Availability & Disclaimer

KPETS is provided “as is” with no guarantee of uptime, availability, or data retention. We are not responsible for outages, data loss, or unexpected technical issues.

This Privacy Policy explains how KPETS collects, uses, stores, and protects your personal data. The site is operated in the United States and follows U.S. law.

Username and email address
Birthday (for age verification)
Discord username
IP address and approximate location
Browser and device information
Avatar images and uploaded artwork
Your pet and gameplay data
Activity logs for security
Your PayPal name/email/shipping address (not stored on KPETS servers; processed by PayPal)
Messages, posts, or data you voluntarily provide on the site

9.2 Why We Collect Data

To operate your account and verify your age
To secure accounts and prevent abuse
To save your pets, items, and progression
To contact you about important account or site issues
To comply with legal obligations

9.3 What We Do NOT Do

We do not sell your personal data.
We do not share data with advertisers.
We do not store credit card information.

9.4 Data Sharing

Your data may be shared only with:

Web hosting providers essential to running the site
Discord (if you choose to join the server)
Other pet sites for resolving cross-site trade issues
Law enforcement if required or if safety is at risk

9.5 International Privacy Compliance

KPETS complies with privacy laws such as GDPR, UK GDPR, CCPA, and PIPEDA for users covered by those laws. Rights such as data access, correction, or deletion will be honored for eligible users.

9.6 Data Access & Deletion Requests

Eligible users (e.g., EU residents) may request:

A copy of the minimal data we store (profile, pets, logs)
Deletion of their account
